1. Acceptance of Terms

By accessing or using the 5a1es_ website and its services, you agree to these Terms of Service and all applicable laws and regulations. If you do not agree to these terms, do not use the site. The site and subscription services are provided by Bartosz Garliński Koncept (NIP 898-182-11-36) of Opłotkowa 11, 51-007 Wrocław, Poland.

2. Services Offered

5a1es_ provides information and training on sales and negotiation techniques. The site includes free content (e.g., articles and blog posts) and a paid monthly subscription service called 5a1es+. The 5a1es+ subscription grants members the following benefits:

  • Access to premium, paywalled content on the website
  • Use of an AI-powered chatbot (using Anthropic’s Claude AI) for practicing sales conversations
  • Access to a downloadable repository of files and resources (the “5a1es+ Knowledge Base”)

Important: All services are provided “as is” without warranties of any kind.

3. Subscription Payment and Billing

The 5a1es+ subscription is billed on a monthly recurring basis. All subscription management (sign-up, renewal, cancellation) and payment processing are handled by the Zanfia platform in cooperation with Stripe (payment gateway). By subscribing, you authorize Zanfia/Stripe to charge your payment method each billing cycle. Subscription fees are charged in advance for each month and are non-refundable, unless requested by the subscriber in the first 14 days following the initial subscription. You may cancel your subscription at any time via the Zanfia platform or through Stripe. Cancellation will prevent renewal after the current billing period; however, no refunds will be given for any unused portion of the billing period.

4. Content Access and License

Subscribers and users are granted a limited, non-exclusive, non-transferable license to access and view the site’s content for personal, non-commercial use only. You may not copy, reproduce, distribute, sell, modify, create derivative works, or publicly display the content on this site, except for personal viewing. Unauthorized sharing or distribution of content, including methods that bypass the paywall, is strictly prohibited and may result in immediate termination of access and legal action.

5. AI Chatbot Service – Special Terms and Limitations

5.1 AI Service Disclaimer

The AI chatbot feature uses third-party artificial intelligence technology (Claude AI API from Anthropic). You acknowledge and agree that:

  • AI responses are generated by automated systems and may contain errors, inaccuracies, or inappropriate content
  • AI-generated content does not constitute professional advice of any kind
  • We have no control over the AI’s responses and cannot guarantee their accuracy, appropriateness, or reliability
  • AI responses are not endorsed by us and do not reflect our views or opinions
  • The AI may experience technical failures, outages, or service interruptions at any time

5.2 User Responsibility for AI Interactions

You are solely responsible for:

  • All inputs you provide to the AI chatbot
  • How you interpret and use AI-generated responses
  • Any decisions made based on AI interactions
  • Ensuring your use complies with all applicable laws and regulations

5.3 Prohibited AI Usage

You agree not to:

  • Use the AI to generate illegal, harmful, offensive, or inappropriate content
  • Attempt to extract proprietary information or reverse-engineer the AI system
  • Use the AI for any commercial purposes without written permission
  • Share AI conversations containing sensitive or confidential information
  • Use the AI to impersonate others or create misleading content

5.4 AI Service Availability

We reserve the right to:

  • Modify, suspend, or discontinue the AI chatbot service at any time without notice
  • Implement usage limits, restrictions, or content filters
  • Terminate your access to the AI service for violations of these terms

6. Third-Party Services and Data Processing

The operation of this site relies on third-party services:

  • Hosting: The website is hosted by Cyberfolks.pl
  • Analytics: We use Google Analytics to collect anonymous usage data
  • Chatbot: The AI chatbot feature uses the Claude AI API from Anthropic
  • Payment: All subscription payments are processed through Stripe via Zanfia

Important: We have no control over these third-party services and are not responsible for their availability, security, or performance. Your data may be processed by these providers according to their own policies. Service interruptions or data breaches by third parties are beyond our control.

7. Intellectual Property

All content on the 5a1es_ website is the intellectual property of Bartosz Garliński Koncept or its licensors. Unauthorized use may result in legal action and claims for damages.

8. User Conduct and Age Requirements

You must be at least 16 years old to use the site and its subscription services. You agree to use 5a1es_ responsibly and lawfully. Any misuse may result in immediate termination of access and potential legal action.

10. Extensive Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages
  • This includes but is not limited to damages for loss of profits, data, business opportunities, or reputation
  • Our total liability to you shall not exceed the amount you paid for your subscription in the 12 months preceding the claim
  • We are not responsible for any damages caused by third-party services, AI malfunctions, or technical failures
  • We are not liable for any content generated by AI systems or how you use such content

11. Indemnification

You agree to indemnify, defend, and hold harmless Bartosz Garliński Koncept from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the services
  • Your violation of these terms
  • Your use of AI-generated content
  • Any content you submit to the site or AI chatbot

12. Force Majeure

We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including but not limited to acts of God, government actions, technical failures, third-party service outages, or AI system malfunctions.

13. Privacy and Data Protection

Your use of 5a1es_ is governed by our Privacy Policy. By using our services, you consent to data processing as described in the Privacy Policy and acknowledge that AI interactions may be processed by third-party providers.

14. Termination

We may terminate or suspend your access immediately, without notice, for any breach of these terms or for any other reason at our sole discretion. Upon termination, all licenses granted to you will immediately cease.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted with a revised “Last Updated” date. Continued use after changes constitutes acceptance of the updated terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

17. Governing Law and Jurisdiction

These Terms are governed by Polish law. Any disputes shall be resolved in Polish courts, subject to mandatory consumer protection laws in your jurisdiction.
